3. User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information

• Not attempt to gain unauthorized access to our systems
• Not interfere with or disrupt our services
• Comply with all applicable laws and regulations

4. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by SmitheryTech PLT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Service Availability

We strive to provide continuous service availability but do not guarantee that our services will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice.

6. Payment Terms

Payment terms for our services are as follows:

• Payment is due according to the terms specified in individual service agreements
• Late payments may incur additional charges
• All prices are subject to change with 30 days' notice
• Refunds are subject to our refund policy as outlined in service agreements
• We accept various payment methods as specified during the ordering process

7. Data Protection and Privacy

8. Limitation of Liability

To the maximum extent permitted by law, SmitheryTech PLT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

9. Indemnification

You agree to defend, indemnify, and hold harmless SmitheryTech PLT and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of our services or violation of these Terms.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will cease immediately.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
